Alıcının sipariş sırasında bildirdiği ad, soyad, teslimat adresi, telefon ve e-posta bilgileri esas alınır.
Bundan sonra “Alıcı” olarak anılacaktır.
2. SÖZLEŞMENİN KONUSU
İşbu Mesafeli Satış Sözleşmesi, Alıcı’nın Jaeline internet mağazası üzerinden elektronik ortamda sipariş verdiği ürünlerin satışı, bedelinin ödenmesi ve Alıcı’ya teslim edilmesine ilişkin tarafların hak ve yükümlülüklerini düzenler.
Ürünlerin temel özellikleri, satış fiyatı, varsa vergiler, kargo/teslimat ücretleri ve siparişe ilişkin diğer bilgiler sipariş aşamasında Alıcı’ya sunulur.
3. SİPARİŞ VE SÖZLEŞMENİN KURULMASI
Alıcı, internet sitesi üzerinden siparişini tamamlayarak sipariş bedelini ödeme yükümlülüğünü kabul eder.
Siparişin Satıcı tarafından kabul edilmesi ve ödemenin başarıyla gerçekleşmesiyle satış sözleşmesi kurulmuş olur.
Siparişe ilişkin bilgiler Alıcı’nın sipariş sırasında bildirdiği e-posta adresine gönderilebilir.
4. ÜRÜN VE FİYAT
Ürünlerin güncel satış fiyatları internet sitesinde ürün sayfalarında ve sipariş oluşturulurken açıkça gösterilir.
Siparişin toplam bedeli, ödeme işlemi tamamlanmadan önce Alıcı’nın onayına sunulur.
Sipariş onaylandıktan sonra ilgili sipariş için belirlenen fiyat değiştirilemez.
5. ÖDEME
Ödemeler, internet sitesinde sunulan güvenli ödeme yöntemleri aracılığıyla gerçekleştirilir.
Ödeme işlemlerinin gerçekleştirilmesi amacıyla üçüncü taraf ödeme hizmet sağlayıcılarından yararlanılabilir.
6. TESLİMAT VE KARGO
Siparişler, sipariş tarihinden itibaren en geç 2 hafta içerisinde kargoya verilmek üzere hazırlanır.
Kargoya teslim edildikten sonraki teslimat süresi, kullanılan kargo/taşıma firmasına ve teslimat ülkesine göre değişiklik gösterebilir.
Türkiye içindeki siparişlerde kullanılacak kargo firması, gönderim tarihinde mevcut olan uygun taşıma seçeneğine göre belirlenebilir.
Yurt dışı siparişlerinde kullanılacak taşıma yöntemi ve tahmini teslimat süresi sipariş aşamasında veya ilgili kargo bilgilerinde belirtilir.
Alıcının ülkesinde doğabilecek gümrük vergileri, ithalat vergileri veya diğer resmi ücretler, aksi açıkça belirtilmediği sürece Alıcı’nın sorumluluğunda olabilir.
7. EL YAPIMI ÜRÜNLER
Jaeline ürünleri el yapımı olarak hazırlanabilmektedir. Bu nedenle ürünlerin hazırlanma süresi, sipariş yoğunluğuna ve ürünün niteliğine bağlı olarak değişebilir.
Satıcı, siparişleri en geç 2 hafta içerisinde kargoya vermek için gerekli özeni gösterir.
8. İADE VE DEĞİŞİM
Jaeline ürünleri el yapımı olarak hazırlanmakta olup, internet sitesinde belirtilen iade ve değişim koşulları uygulanır.
Yürürlükteki tüketici mevzuatı kapsamında Alıcı’nın sahip olduğu emredici yasal haklar saklıdır.
Üründe üretimden kaynaklanan bir sorun, ayıp, hasar veya siparişle uyuşmayan bir durum bulunması halinde Alıcı, jaelinespieces@gmail.com adresinden Satıcı ile iletişime geçebilir.
Sorunun hızlı şekilde değerlendirilebilmesi için Alıcı’nın sipariş numarasını ve mümkünse ürünün durumunu gösteren fotoğrafları paylaşması önerilir.
9. ÜRÜNDE SORUN VE HASAR
Ürünün teslimatı sırasında taşıma kaynaklı görünür bir hasar bulunması halinde Alıcı’nın mümkün olan en kısa sürede Satıcı ile iletişime geçmesi önerilir.
Ürünün ayıplı, hasarlı veya sipariş edilen üründen farklı olması halinde Alıcı’nın yürürlükteki mevzuattan doğan yasal hakları saklıdır.
10. KİŞİSEL VERİLER
Alıcı tarafından sipariş sırasında paylaşılan kişisel veriler; siparişin alınması, ödeme işleminin gerçekleştirilmesi, ürünün hazırlanması, gönderilmesi ve müşteri hizmetlerinin sağlanması gibi amaçlarla işlenebilir.
Kişisel verilerin işlenmesine ilişkin ayrıntılı bilgiler internet sitesinde bulunan Gizlilik Politikası ve ilgili kişisel veri bilgilendirmelerinde açıklanmaktadır.
11. MÜCBİR SEBEPLER
Tarafların kontrolü dışında meydana gelen doğal afet, savaş, salgın, yangın, grev, ulaşım sorunları, kargo veya lojistik hizmetlerindeki kesintiler, resmi makamların kararları ve benzeri öngörülemeyen durumlar nedeniyle yükümlülüklerin zamanında yerine getirilememesi halinde ilgili taraf sorumlu tutulamaz.
12. UYUŞMAZLIKLAR
İşbu sözleşmeden doğabilecek uyuşmazlıklarda, uygulanabilir olduğu ölçüde yürürlükteki tüketici mevzuatı ve ilgili diğer mevzuat hükümleri uygulanır.
Alıcı’nın tüketici olarak sahip olduğu yasal başvuru hakları saklıdır.
13. YÜRÜRLÜK
Alıcı, internet sitesi üzerinden siparişini tamamlamadan önce işbu sözleşmenin hükümlerini okuyup kabul ettiğini beyan eder.
İşbu sözleşme, siparişin tamamlanmasıyla birlikte yürürlüğe girer.

Hereinafter referred to as the “Seller.”
BUYER
The Buyer’s name, surname, delivery address, telephone number and email address provided during the ordering process shall be taken as the basis.
Hereinafter referred to as the “Buyer.”
2. SUBJECT OF THE AGREEMENT
This Distance Sales Agreement governs the rights and obligations of the Seller and the Buyer regarding the sale, payment and delivery of products ordered electronically through the Jaeline online store.
The main characteristics of the products, their prices, applicable taxes, shipping/delivery charges and other relevant order information are presented to the Buyer during the ordering process.
3. ORDER AND CONCLUSION OF THE AGREEMENT
By completing an order through the website, the Buyer agrees to pay the total order amount.
The sales agreement is concluded once the order is accepted by the Seller and the payment has been successfully completed.
Order information may be sent to the email address provided by the Buyer during the ordering process.
4. PRODUCTS AND PRICES
Current product prices are clearly displayed on the relevant product pages and during the ordering process.
The total order amount is presented to the Buyer for approval before payment is completed.
Once an order has been confirmed, the price applicable to that order cannot be changed.
5. PAYMENT
Payments are processed through the secure payment methods made available on the website.
Third-party payment service providers may be used to process payments.
6. SHIPPING AND DELIVERY
Orders are prepared for shipment within a maximum of 2 weeks from the date of the order.
Delivery times after shipment may vary depending on the shipping carrier and destination country.
For orders within Türkiye, the shipping carrier may be selected according to the available and appropriate shipping option at the time of dispatch.
For international orders, the shipping method and estimated delivery time will be provided during the ordering process or in the relevant shipping information.
Customs duties, import taxes and other official charges that may arise in the Buyer’s country may be the responsibility of the Buyer unless otherwise expressly stated.
7. HANDMADE PRODUCTS
Jaeline products may be handmade. Therefore, preparation times may vary depending on order volume and the nature of the product.
The Seller will make reasonable efforts to dispatch orders within a maximum of 2 weeks.
8. RETURNS AND EXCHANGES
Jaeline products are handmade, and the return and exchange conditions stated on the website shall apply.
Nothing in this Agreement shall limit any mandatory statutory consumer rights applicable to the Buyer under the laws of the relevant jurisdiction.
If a product has a manufacturing defect, is damaged, or does not correspond to the product ordered, the Buyer may contact the Seller at jaelinespieces@gmail.com.
For a prompt assessment of the issue, the Buyer is advised to provide the order number and, where possible, photographs showing the condition of the product.
9. DAMAGED OR DEFECTIVE PRODUCTS
If the product appears to have been damaged during transportation, the Buyer is advised to contact the Seller as soon as reasonably possible.
If the product is defective, damaged or different from the product ordered, the Buyer’s statutory rights under applicable law remain unaffected.
10. PERSONAL DATA
Personal information provided by the Buyer during the ordering process may be processed for purposes including receiving and fulfilling orders, processing payments, preparing and shipping products, and providing customer support.
Further information regarding the processing of personal data is provided in the Privacy Policy and relevant personal data notices available on the website.
11. FORCE MAJEURE
Neither party shall be held responsible for delays or failures to perform its obligations caused by circumstances beyond its reasonable control, including natural disasters, war, epidemics, fire, strikes, transportation disruptions, interruptions to shipping or logistics services, decisions of public authorities and other unforeseeable events.
12. DISPUTES
Any disputes arising from this Agreement shall be subject, to the extent applicable, to the consumer protection legislation and other applicable laws in force.
The Buyer’s mandatory statutory consumer rights remain unaffected.
13. EFFECTIVE DATE
By completing an order through the website, the Buyer confirms that they have read and accepted the terms of this Agreement before completing the purchase.
This Agreement becomes effective upon completion of the order.
